Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of the Lunar Sanctuary website and the Lunar Sanctuary mobile application (together, the “Services”) operated by Lunar Sanctuary Church (“the Church,” “we,” “us,” or “our”). By accessing the Services, becoming a member, or posting content, you agree to be bound by these Terms and by our Privacy Policy and Community Guidelines. If you do not agree, do not use the Services.
Membership Eligibility
Membership is open exclusively to adults 21 years of age or older who sincerely hold religious beliefs in the spiritual significance of entheogenic sacraments. By completing the membership process, you represent and warrant that you meet these requirements and that your affirmation of sincere religious belief is truthful.
Geographic Scope
The Services are offered from, and intended for members located in, the United States. We make no representation that the Services are appropriate or available for use outside the United States. If you access the Services from elsewhere, you do so on your own initiative and are responsible for compliance with all laws that apply to you.
Religious Nature; Sacrament Disclaimer
Lunar Sanctuary Church is a sincere religious community. Our observances are undertaken as an expression of sincerely held religious beliefs and not for recreational purposes, and we seek recognition of the free exercise of religion, including under the Religious Freedom Restoration Act (RFRA) and applicable law.
Nothing in the Services is legal, medical, or therapeutic advice. Information provided is for religious and educational purposes only. Laws concerning sacraments vary by jurisdiction and change over time. You are solely responsible for understanding and complying with all laws applicable to you. The Church does not guarantee any particular legal outcome or protection, and participation is undertaken at your own discretion and risk.
Your Account
You agree to provide accurate information, to keep your login secure, and to maintain only one account. You are responsible for activity under your account. Notify us promptly of any unauthorized use.
Community and User Content
The Services include a member forum and other features where you may post content (“User Content”). You retain ownership of your User Content, and you grant the Church a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it within the Services for the purpose of operating the community. You are solely responsible for your User Content and represent that you have the right to post it.
Zero Tolerance for Objectionable Content and Abusive Behavior
There is no tolerance for objectionable, abusive, harassing, or unlawful content or conduct. By using the Services you agree that you will not post such content or behave abusively toward other members. Prohibited content and conduct include, without limitation:
- Harassment, threats, bullying, hate speech, or content that demeans others based on protected characteristics;
- Sexually explicit, obscene, or violent content;
- Content that solicits, arranges, advertises, or facilitates the sale, sourcing, or unlawful distribution of any controlled substance or other illegal transaction;
- Impersonation, doxxing, or sharing others’ private information;
- Spam, scams, malware, or unauthorized advertising;
- Content that infringes intellectual property or violates any law.
You may report objectionable content and block abusive members directly within the app. We review reports and act on them, including removing content and ejecting offending members, generally within 24 hours. We may remove any content and suspend or terminate any account at our discretion, with or without notice. User Content is visible to other members and should not be considered private.
Acceptable Use
You agree not to misuse the Services, including by attempting to breach security, disrupt the Services, scrape or harvest data, reverse engineer the application, or use the Services for any unlawful purpose.
Intellectual Property
The Services, including their design, text, logos, and graphics (excluding User Content), are owned by the Church and protected by law. You may not copy or reuse them without permission.
Copyright Complaints
If you believe content on the Services infringes your copyright, contact us through our Contact page with a description of the work, its location on the Services, your contact information, and a good-faith statement. We will respond to valid notices.
Offerings and Contributions
Sacramental offerings and contributions made through the Services are religious in nature and are final. Please review our Returns & Refunds Policy. Purchases open in your device’s web browser and are handled outside the mobile application.
Third-Party Services and Links
The Services may link to or rely on third parties (such as Apple, Google, and our store). We are not responsible for third-party services, and your use of them is governed by their terms.
Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
Limitation of Liability
To the fullest extent permitted by law, the Church and its members, clergy, officers, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of the Services. Our total liability for any claim will not exceed one hundred U.S. dollars ($100).
Indemnification
You agree to indemnify and hold harmless the Church and its members, clergy, officers, and volunteers from any claims, damages, or expenses arising out of your use of the Services, your User Content, or your violation of these Terms or any law.
Termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may delete your account at any time from within the app.
Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in the State of Utah, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. We will post the updated version here and revise the “Last Updated” date above. Continued use of the Services after changes take effect constitutes acceptance.
